Agreement to Terms
By accessing or using the services provided by BRV Brownsville Masonry, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services or website. We reserve the right to update these terms at any time, and continued use of our services constitutes acceptance of any changes.
Services Provided
BRV Brownsville Masonry provides professional masonry services including but not limited to brick repair, stone installation, tuckpointing, chimney repair, retaining walls, paver installation, and related masonry work. All services are performed by licensed and insured contractors in accordance with local building codes and industry standards.
Service descriptions on our website are for general information purposes only. Specific project details, timelines, and pricing will be outlined in written estimates and contracts provided before work begins. We reserve the right to refuse service to anyone for any lawful reason.
Estimates and Pricing
Free estimates are provided based on on-site inspections and are valid for 30 days from the date of issue. Actual project costs may vary if site conditions differ from the initial assessment or if you request changes to the scope of work. Any changes to the original estimate will be discussed and approved in writing before additional work is performed.
Payment terms will be specified in your contract. We typically require a deposit before starting work, with the balance due upon project completion. We accept cash, check, and major credit cards. Late payments may be subject to additional fees as outlined in your contract.
Project Timeline and Delays
We provide estimated project timelines based on the scope of work and current scheduling. While we strive to meet all deadlines, actual completion dates may be affected by weather conditions, material availability, permit delays, or unforeseen site conditions. We will communicate any delays promptly and work to minimize disruption to your schedule.
Permits and Approvals
You are responsible for obtaining any necessary permits, homeowner association approvals, or other permissions required for your project. We can assist with permit applications and provide technical information as needed, but final responsibility for securing approvals rests with the property owner. Additional fees may apply for permit assistance services.
Warranties and Guarantees
We stand behind our workmanship and offer warranties on completed projects as specified in your contract. Warranty coverage typically includes defects in materials and workmanship but does not cover damage caused by improper maintenance, acts of nature, or unauthorized modifications. Material warranties are provided by manufacturers and are subject to their terms and conditions.
To maintain warranty coverage, you must follow any maintenance recommendations provided at project completion. Claims must be reported promptly in writing. We will assess the issue and determine the appropriate remedy under the warranty terms.
Limitation of Liability
To the fullest extent permitted by law, BRV Brownsville Masonry shall not be liable for any indirect, incidental, special, or consequential damages arising from our services. Our total liability for any claim related to our services shall not exceed the amount paid for those services. This limitation applies regardless of the legal theory on which the claim is based.
Property Access and Safety
You agree to provide safe and reasonable access to the work area and to secure any pets during our scheduled work hours. We will take precautions to protect your property but are not responsible for damage to landscaping, sprinkler systems, or underground utilities that are not properly marked. You should contact local utility location services before work begins.
Our team follows all applicable safety regulations and uses appropriate personal protective equipment. Work areas may be hazardous during construction. We ask that you keep children and pets away from active work zones for their safety.
Cancellation and Refunds
Cancellation policies will be outlined in your contract. Generally, cancellations made before work begins may result in forfeiture of the deposit to cover administrative costs and lost scheduling opportunities. Cancellations after work has started will be billed for work completed and materials ordered. Refunds, if applicable, will be processed according to the terms specified in your contract.
Dispute Resolution
We are committed to resolving any concerns or disputes amicably. If you have an issue with our services, please contact us directly so we can work toward a solution. Any disputes that cannot be resolved through direct communication may be subject to mediation or arbitration as specified in your service contract.
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any legal action or proceeding relating to these terms shall be brought exclusively in the courts of Cameron County, Texas.
